What is alimony?
Spousal support, sometimes referred to as alimony is the financial support paid by one former spouse to the other on top of any sums paid for the division or partition of the marital assets.
Alimony can be paid continuously, typically on a monthly basis, or can be received as a lump sum payment.
Some of the elements considered by the Courts when rendering such an order are the following:
Duration of the marriage
Roles of each of the spouses during the marriage (i.e. Were both spouses working? Did one spouse stay at home and raise the children?)
Financial means and needs of each spouse
It should be noted that in Quebec only married couples are entitled to seek spousal support. Consequently, common law spouses are not eligible for such claims.
